In this case, the neighbor’s Italian Greyhound dog, Puccini, injured Bevers who did not attempt to provoke the animal when he tried to close the lid. Bevers was peaceably conducting himself when he entered the house; he was not under any drug or alcoholic influence at the time of the injury. Lastly, Bevers was an invitee to Castro’s party and his presence on Castro’s property was lawful. He was peaceably and lawfully conducting himself in the party at the time of the injury. After the bite Bevers needed a tetanus shot and seven stitches. The elements of the animal attack are all met; therefore, the animal attack section is undisputed. The case facts establish all elements of the animal attack required under the Act.
