I do not know about laws that can be applied for this case. Therefore, I think that Herman should determine that using Diana's grant proposal is whether illegal or not. Herman should also consider potential risks, such as loss of credit or honor. After that, he should decide which way is the most reasonable way to success without the problem. I think that benchmarking is a useful strategy, but Herman should be sure that his group are licensed and they maintain legal status.
