Baker because Mrs. Thomas did discriminate against her on several occasions. First, were the insensitive comments made towards Mrs. Baker. Second, was Mrs. Thomas admitting she did, in fact, tell Mrs. Baker to change her appearance to look like other co-workers who were much younger than her. Third was when she fired Mrs. Baker in retaliation because she refuse to discriminate against other co-workers by firing them. Fourth was Mrs. Thomas bogus claim that she had to discipline Mrs. Baker which led to her also being fired. Therefore as the presiding judge over Baker vs. Silver Oaks, I recommend this case go before a jury because Silver Oak management violated the characteristics associated with the Age Discrimination in Employment Act. This act prohibits any employee from being discriminated on due to their age (Schuster & Miller, 1984). Therefore, instead of Mrs. Thomas discriminating against Mrs. Baker she should've shown her the respect as an elder and the Director of an Assisted Living Facility. She didn’t have to be so biased towards older people because if she was this way with workers you can only image how she felt about the ones living at the facility. Consequently, her behavior led to a lawsuit that could have been avoided if Mrs. Thomas wasn't so biased toward older
