Attached is a memorandum assigned in conjunction with my first-year Legal Research and Writing course. This assignment required me to conduct original research and draft an office memorandum addressing whether Veep Omboni Records inclusion of three music samples into a new single would constitute copyright infringement under the Copyright Act of 1976. Specifically, I analyzed whether the inclusion of any of the samples constitute copyright infringement of sound recordings when only small fragments of the copyrighted song were going to be used and would be digitally altered. A main issue in the memorandum was the existence of circuit split as to whether or not courts should recognize a de minimis exception to copyright infringement of sound
