At Will Employment Policy

If you are employed at-will, which means that an employee for any reason can be released by an employer with no reasoning or cause (Bernardin & Russell, 2013). Many states have adopted the at-will policy, Montana is the only state that has not adopted the at-will employment policy. However, if one can prove he/she was fired due to discrimination or retaliation that could possibly leave to a law suit. To protect their right to fire at will, many employers ask job applicants and new employees to sign a written statement agreeing that they are or will be employed at will. Some companies will give you reason as to why you are being terminated whether it is a reduction in work force, poor work ethic, budget cuts and so forth. Having many years of experience in HR, I have had the experience of how the at-will policy can hinder a work environment or better yet it can also be helpful. Sometimes employers will use this policy to terminate employees for matters that have no relation to their employment. …show more content…
