There are many reasons for which the middle road can be preferred. It would probably empower all sides to retrieve triumph. The government could assert that its amendment procured the Court’s stamp of endorsement, the petitioners could claim that they succeeded in having important safeguards infused into the appointments process, and the Court could send the message that it has effectively protected constitutional rights without thwarting the democratic will.
