Argumentative Essay: Satellite Dish Violation

I intentionally left Drobney out of this reply until we agree on the path forward.

Satellite dish violations are simply matters of enforcement. According to the covenant, Satellite dishes are prohibited. Hence, it is incumbent upon us as board member to non-selectively execute the spirit of the governing documents and ,therefore, treat satellite dish violations like any other violations.

Nevertheless, I understand that we all have a personal stake in this matter for the mere fact that we are all homeowners. Barring having to grandfather this matter and having to rewrite the covenant, I move that satellite dish owners have the following options to abate:

A. Owner removes the satellite dish at owner's expense within 30 days following notice of violation. (I owner bears the expense because he willing/unknowing violated or purchased a home with a preexisting dish.) Moreover, the HOA should NOT inherit the related exterior maintenance due a violation of the covenant; furthermore, any subsequence roof leaks due to improper removal, should be subrogated to the current owner.

Owner keeps the satellite dish and pays a month fine as long as the dish is present. I fine should be capped monthly, but not limited to a maximum dollar amount. Note, the HOA is not seek to shut off water for satellite dish violation.

Pros - This is an additional revenue stream. Furthermore, the additional funds can help offset suspending active board members HOA dues. I would favor waiving active board members HOA dues if we institute a $20/mo fine (added to their monthly HOA dues) for each owner that has a satellite dish present (active or not active) now or in the
