Are Judges Making Custody Decisions

Decent Essays
Hi guys,

I feel there are tons of things that play a big role when judges are making custody decisions. Many require for each of the parents home and finances to be looked into to see who's best fit to keep the child. Most judges make sure there are no drugs in the house hold, they check the parents own personal records to make sure they are not convicted of any crime and they also at some cases listen to the child to see who they would rather live with. The statutes are here to make sure that the judges have something to go by before actually making the decision or final court ruling. I believe the "best interest of the child statutes" are like a judges own personal guide that many of them have to follow in order for them not to just look

The following case study is from Pennsylvania Juvenile Courts February 2014 that involves a corrupt ‘kids for cash’ scheme that landed many teens in a juvenile detention center. Judge Ciavarella placed about three-thousand juveniles in detention for their minor violations opposed to giving them a warning or chance to change their behaviors. In exchange for sending the children away, the judge received over a two million dollar profit from the facility which housed the delinquents. The carless actions of Judge Ciaverella robbed many teens of their high school years. One of the most significant results of how the Judges greed affected minors, is the death of Ed Kenzakoski.…

Joshua was physically abused by his father, and taken in by social services; however he was returned home very soon.…

The first legal issue is in relation to tort law. As tort law currently stands if a permit is ordered from the Court to detain a woman that is pregnant against her wishes but in order to protect the unborn child she is currently caring. Her actions will harm the child overall. The second legal issue comes from the other perspective. If the Court does have the power to make orders based on the protection of children (or unborn children), and can this be extended to protect the child against the mothers…

STUDENT NOTES AND COMMENTS ON THE CASE: I stand by the Court’s decision to uphold Roe v. Wade because I believe that whether a woman chooses to abort her fetus or not should ultimately be left up to her. The State should not have the authority to forbid abortions up until the fetus is able to live outside of the womb, at which point I believe that it is not moral nor should it be legal to abort the fetus. I agree with the decision made in the case of Planned Parenthood v. Casey to uphold the requirements for informed consent and a 24-hour waiting period. In regard to the reporting requirements, I believe that it is important to keep such records for medical, scientific and statistical reasons. Without such records, medical research on abortions…

It becomes an issue when a person attempts to gain legal custody of a child based off of their own opinion rather than the law. My client should not be considered a neglectful parent seeing as he is more than capable of providing suitable care for his children. Not only that, he makes a genuine effort to make them more open-minded individuals. Why move children to another home when the home they were in before was perfectly suitable? It would do more harm than good to move them.…

When we think of a typical American family, we think of a hard working mom and dad, happy kids, finically stable as well as emotionally stable, and a very close family relationship. The sad truth is not many families are like the typical American family. There are families whose parents are force to give up their kids to child services, because they cannot afford to feed the hungry mouths of their children. In “Foster Care and the Politics of Compassion,” Nanette Schorr informs and persuades the audience about the child-protective system and the stigma behind it all. Schorr illustrates a case where a mother and her three kids were cast aside from their abusive husband and father.…

Casey. The Supreme Court saw the notification requirement as a burden on women who may fear for their safety or their children’s safety, but this contains one major flaw. The flaw in this conclusion is that, although this helps women who are in abusive relationships, it harms fathers who are not abusive and whose only goal is to raise their child. The father’s rights are ripped away from him without his knowing of it and this is undeniably…

Father who fights for custody is rare, therefore many judges feel the father should be awarded custody for loving his children, or they assume that something is wrong with the mother. The mother and her children are being systemically impoverished, psychologically and legally harassed, and physically battered by the very father who is fighting for custody (Chesler, Phyllis1990). Society believe that some children are better off with their fathers. When non-custodial fathers are highly involved with their children’s learning, the children are more likely to get A's at all grade levels (NCES 2007-040). How many women do you know that pay child support?…

Anytown’s Department of Job and Family Services recently implements a new policy regarding child endangerment. To most people you would think for anyone to be charged with child endangerment, it had to be a very serious matter. What most people don’t realize is child endangerment could be simply leaving your child unattended. Nevertheless, child endangerment occurs when a person engages in conduct that places a child in imminent danger of death, bodily injury, or physical or mental impairment. I believe if a household has one or more documented offense that could put the child in a compromising position.…
