Son, two daughters and mother suffered serious injuries after motor vehicle accident. The father, Robert Schofield, was in the US and received a call from his daughter, Erin telling him about the accident and that his wife has been killed. Robert started to call airlines to transport his children back to the US. Robert called Air Evac and they proceed to tell him that they were not transporting anyone until the children were stable. Critical air employee called Critical Air in the ambulance telling them that arrangements have already been made and that the kids were going with Air Evac. Critical Air President, Metz, called Robert believing that he could convince him to fly with Critical Air instead and said “ Don’t bother with Air Evac, we will get the kids, we already have all of their information.” ( Clark 2). Metz knew that Air Evac was already sending a plane, so he sent a Critical Air plane to Mexico as well. Metz called the hospital making the arrangements and admitted to having permission from Robert Schofield thus sending the plane anyways. Robert Schofield then sued Critical air for negligence, false imprisonment of the Laura and Erin and intentional infliction. Robert blamed the airline for his son’s death, when it was the brain trauma that killed him. The jury did not find Critical Air guilty for David’s death. However, the jury did find Critical Air guilty for falsely imprisoning the girls, in resulting 60,000 dollars to Erin and Laura each and Robert also received 68,000 dollars for his sons
