Due to the disclosures during Schemer’s second interview, Anderson was brought in for a follow up interview where he was advised of Garrity by Dir. Smith. Anderson had two questions: does he need a lawyer and what exactly this interview is pertaining to. Smith explained the difference between criminal and administrative rights and answered his questions. Anderson said his concern was that if he didn’t exactly recall correctly the questions we already asked him, then this could be used to say he lied. After all questions were answered, Anderson read and signed the Garrity form.

He said he and Schemer have spoken, but just to say that they are being interview. Anderson was asked if he contacted her, he said she contacted him. When he was asked if she lied when she told us that he contacted her first, he said she may be. He then changed his story to he didn’t recall who called who first. When asked what was discussed, he said he said there was an investigation going on, they couldn’t talk about it, and left it at that. Anderson was confronted with Schemer statement about him believing we would twist their words, to which he said he did not say that. When asked if she was lying, he said she may be and it was for us to determine. As he pressed on this topic, he said he may have said he was displeased with one of the answers to a question he was asked about if he was angry with Hale. Anderson was asked if he and Schemer ever had a discussion about the only way anything would happen to Hale is if they had proof, like a recording. Anderson said no, he doesn’t recall saying it specifically like that, only that this would happen again and there would be proof. However, he denied telling her to be ready. Anderson was then asked if gaining proof, like a recording, would be needed. He said no, then he said he told her recordings could not be used. Anderson explained that he told her recording was not allowed after she told him she had a recorder and she could record stuff, it was state law that she could record someone if she needed to protect herself.
