It’s easy to want to believe that all juveniles are incident and unable to commit a horrible crime intentionally, but this is simply wishful thinking. Should juveniles accused of violent crime’s be tried and sentenced as adults? Well it depends on two main factors, the specific violence and whether or not the child demonstrated a full understanding of what he or she was actually doing. Up until around age 7, children are in a pre-operational way of thinking. In most violent situations juveniles do not comprehend their actions. However, if the juvenile committed a crime that was fully intentional they should not be given a lesser punishment then an adult who committed the same crime just because of their age. He was tried as an adult and convicted of first-degree murder. It was later discovered that he was not intentionally meaning to kill the 6 year old girl he was just pretending to be a particular world wrestler when he beat the little girl. In cases such as this, it sounds like an accident more than intentional. So, should he have been tried as an adult for this crime? No, I don’t believe he should have because taking her life was not something he had planned to do he was just pretending like children do and took it to far he had no understanding of what he was actually doing and how the moves he made could really hurt someone. His life should not have been completely taken away from him because he was imitating something he had seen. Even at 12 years old children don’t understand that what they see on Television is not always real. It might be argued that because he was 12 years old that he should have understood the consequences of his actions; chances are though that it never crossed his mind that he was much bigger and therefore stronger than the little girl he was playing

Overall I think my opinion is yes that he should have been tried as an adult. I know kids are kids and they have time to learn but in cases of kids killing people I think it's a different story. I would be more understanding about the situation if he had maybe stop beating the victim after he was already down and hurt but he continued to grab other items to kill the victim. If any child feels in danger and feels the need to fight back yes I think they should but not intentionally to kill them just enough to get away and ask for…

The article, “Juveniles Should Be Tried As Adults” by Mary Estudillo, brings up many strong arguments as to why juveniles should be tried as adults, but the opposing article, “Juveniles Should Not Be Tried As Adults” written by Hannah McCrea strongly claims they should not. Estudillo cites examples of cases in which juveniles committed first and second degree murder, and were thereafter tried as adults. She explains how juveniles should be tried as adults because they are criminals, and criminals need to held responsible for their actions. She also brings up how rehabilitation does little to sometimes nothing for the child, so when they are released, they commit another crime. Alternatively, McCrea authored “Juveniles Should Not Be Tried As Adults,” and states how adult prisons do more harm than good for juveniles.…

If a juvenile committed a crime do you think they should spent their childhood and adulthood in prison for life? The Supreme court ruled that juveniles who commit crimes should not be sentenced to life in prison because it violates the 8th amendment. However some judges strongly disagree that juveniles who commit heinous crimes should always be punished with a sentence of life in prison. From my point of view juveniles who commit crimes should be accountable for their crimes but they shouldn’t get life in prison. Firstly, I disagree because most juveniles are at a young age and their brain is not fully developed.…

Juvenile’s brains are also not fully developed. This made it unconstitutional to sentence juveniles to life without the possibility of parole. I think this is a fair law because juveniles may be completely different once they hit adult hood, but the case of Miller V. Alabama made me feel differently. I still believe that he should be sentenced heavily. At the time of his crime he was fourteen, and fourteen year olds know that it is not right to murder someone.…

Juveniles should not be tried as adults for it is wrong to hold adolescents, under the legal age, to adult standards. If children do not even receive the same rights as adults in the first place, it makes no sense to try them in adult court. These juveniles should have the opportunity to be rehabilitated in a positive manner, for they tend to come from troubled households and violent neighborhoods. In over half of the cases these troubled kids don’t know any different way than a life of crime when surrounded by both social and environmental factors that influence their delinquent actions. One must commemorate that juveniles are mentally underdeveloped, and still have time to innovate if their issues are dealt with precisely and accurately.…
