- Waiver to adult court occurs by according to Taylor R.& Fritsch E. (2011 P. 12), “certification, or transfer, and involves a juvenile court’s relinquishing its jurisdiction over the offender and allowing a juvenile to be sent to adult court for prosecution.” The main reason to waive a juvenile to adult court is if he or she commits a delinquent crime that would have been a crime if committed by an adult and if the prosecutor chooses not to file a petition the prosecutor them has the option to waive the juvenile to criminal justice system for prosecution.

On the other hand, adult courts focus more on keeping the adult out of the community their primary goal is not to rehabilitate. A juvenile need more leniency and opportunity to change. An adult court cannot provide that for them.

- Historically, juveniles were viewed as property in the name of the law the legal term is chattel. According to Taylor R. & Fritsch E. (2011 P. 24), “Juveniles were treated the same as an adult in the Criminal Justice System and subjected to the same penalties, including death. Children did not receive special protections in the Criminal Justice System, nor were they allowed special privileges in other segments in society.”
