Purposefully terminating an unborn child should be banned in accordance with the laws that defend all life. Prior to Roe vs. Wade, Texas criminal abortion laws, which were first enacted in 1854, made it illegal to perform this murderous procedure except to save the life of the mother (Roe v. Wade). Not only was it illegal to perform or undergo the procedure, it was prosecutable to refer a woman to illegal abortion providers (ROE V. WADE). Among these criminal laws lies the Fourteenth Amendment which makes all persons residing in America a citizen with non prohibitable rights to life, liberty, and property (14th Amendment). This child, regardless of which stage of development, is a human being and deserves the right to life like every other human being. By definition, a live birth is determined by any signs of life including breathing, pulsation of the umbilical cord, detectable heartbeat, or movement of voluntary muscles. Babies that are born alive possess one or more of these characteristics (Hyde Amendment). This law was signed by President George W. Bush and received unanimous consent from the Senate and is still a current federal law (Hyde Amendment). After six months, if the baby is born prematurely, it may survive under intensive care (Fetal Development). The Born-Alive Infants Protection Act vows that every infant born alive falls under its protection. Therefore, most failed termination attempts performed later in the pregnancy result in a live birth, granting that child a right to life. An instance of a live birth abortion was conducted on a mother who was beyond 23 weeks pregnant. Once the procedure was complete, the baby was estimated to have a 39 percent chance of survival, had the mother chosen to provide the proper care and attention to her child (Hyde Amendment). This women opted for the lethal alternative and the newborn was wrapped in a disposable blanket and left to suffer for over two hours before she passed away (Hyde Amendment). During those few hours, that child was considered living by her detectable heartbeat. For that short amount of time, that baby’s body was working to keep her alive to the best of its abilities. Unfortunately, without the necessary medical intervention that she was entitled to under the Born-Alive Infants Protection Act, the child had no chance of surviving, no matter how hard her body fought against the odds (Hyde Amendment).
