This lawsuit rises out of Hiawatha Shores claim of ownership and request for possession of certain equipment and materials located on property owned by Defendant/Counter-Plaintiff Eric Buckler. Plaintiff/Counter-Defendant Hiawatha Shores moves for Summary Disposition pursuant to MRC 2.116 © (9)(10) on the grounds that Hiawatha Shores is the owner of the equipment and materials located on the property in question and that it is entitled to possession of the equipment and materials and immediate removal of said equipment and materials.
II. STATEMENT OF FACTS In support of its Motion for Summary Disposition Hiawatha Shores relies upon Exhibits I and II attached to its Motion for Summary Disposition. The property formally known as the “Fritz Chip Plant” is located in the Township of Pentland, County of Luce, in the State of Michigan. See description of the property where the equipment and materials are located attached to Exhibit I, attachment A. On August 1, 2001, Hiawatha Shores purchased certain equipment and materials located on the piece of property known as the “Fritz Chip Plant” property. See Exhibits I and II attached to this Motion for Summary Disposition. The equipment and materials were purchased from a bank. The equipment and materials were acquired through the Comly Auctioneers and Appraisers’ sale.
