Alcohol Concentration
(A) Not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body; or
(B) having an alcohol concentration of .08 or more.
Intoxicated
A self-propelled vehicle or a vehicle that is propelled by electric power from overhead trolley wires. The term does not include an electric bicyle or an electric personal assistive mobility device.
Motor Vehicle
A vessel, one or more waer skis, and aquaplane, or another device used for transporting or carrying a person on waer, other than a device propelled only by the current of water.
Watercraft
A bottle, can, or other receptacle that contains any amount of alcholic bevrage and that is open, that has been opened, that has a broken seal, or the contents of which are partially removed.
Open Container
The entire width between and immediately adjacent to the boundary lines of any public road, street, highway, interstate, or other publicly maintained way if any part is open for public use for the purpose of motor vehicle travel. The term inlcudes the right-of-way of a public highway.
