THE TEXAS SUNSET ACT
THE TEXAS SUNSET ACT REQUIRES THAT MOST STATE AGENCIES UNDERGO A REVALUTION, USUALLY ON A 12-YEAR CYCLE, TO DETERMINE THE NEED FOR THEIR CONTINUENCE.

THE PRIMARY FUNCTION OF THE LEGIGSLATIVE AUDIT COMMITTEE IS TO AUDIT (FORMALLY REVIEW) THE EXPENDITURES OF THE STATE AGENCIES AND DEPARTMENTS.

THE LEGISLATIVE COUNCIL
THE LEGISLATIVE COUNCIL FUNCTIONS AS A SOURCE OF INFORMATION AND SUPPORT TO THE LEGISLATURE, STATE AGENCIES, AND OTHER GOVERMENTAL INSTITUTIONS. IT PROVIDES RESEARCH SUPPORT TO LEGISLATORS AND HELPS THEM DRAFT LEGISLATICE PROPOSALS.

MOST STATES, THE US GOVERNMENT, AND MOST COUNTRIES HAVE ONLY ONE BUDGET. TEXAS HAS TWO. EACH AGENCY IN STATE GOVERNMENT PRESENTS ITS BUDJET REQUESTS TO BOTH THE GOVERNOR'S OFFICE AND THE LEGISLATIVE BUDJET BOARD.

IN A COMMITTEE OF A WHOLE, ONLY A SIMPLE MAJORITY RATHER THAN THE USUAL 2/3 IS NECISSARY TO CONSIDER LEGISLATION, AND THE LEGISLATION, AND THE LIEUTENANT GOVERNER MAY DEBATE AND VOTE ON ALL QUESTIONS, BUT OTHERWISE THE SENATE RULES ARE OBSERVED. NO JOURNAL IS KEPT OF THE PROCEEDINGS.
WHAT IS MEMBERSHIP DETERMINED BY?
THE RESPECTIVE PRESIDING OFFICER APPOINTS 5 MEMBERS FROM EACH HOUSE FROM THE CONFERENCE COMMITTEES IN TEXAS.
COMMITTEE OF A WHOLE
THE SENATE MAY ALSO FORM ITSELF INTO A COMMITTEE OF A WHOLE, AT WHICH TIME THE LIEUTENANT GOVERNER APPOINTS A SENATOR TO PRESIDE.
IN BLOCKING A BILL
THE SENATE PRACTICE AFFECTS THE SENATE'S ENTIRE LEGISLATIVE PROCESS. THE IRONY IS THAT WHILE ONLY A SIMPLE MAJORITY IS NECESSARY FOR FINAL PASSAGE IN THE SENATE, A 2/3 MAJORITY IS NECESSARY TO GET THE BILL TO THE FLOOR FOR CONSIDERATION.
WHAT IS A BLOCKING BILL?
THE FIRST BILL PLACED ON THE SENATE CALENDER EACH SESSION IS CALLED A BLOCKING BILL. IT IS USUALLY A BILL DEALING WITH A HORTICULTURAL CHANGE SOMEWHERE AROUND THE STATE, CAPITOL OR IN THE STATE PARK SYSTEM. IT WILL NEVER BE TAKEN OFF THE CALENDER.
WHAT IS A BLOCKING BILL? 2
IT DOES HOWEVER "BLOCK" THE CONSIDERATION OF ALL OTHER BILLS ACCESS TO THE FLOOR EXCEPT BY THE 2/3 VOTE TO SUSPEND THE RULE THAT REQUIRES CHRONOLOGICAL CONSIDERATION OF BILLS.

IN A PARLIAMENTRY FORM OF GOVERNMENT, LEGISLATURES ACTUALLY SERVE AS ADMINISTRATORS; IN THE UNITED STATES, LEGISLATURES HAVE A WATCHDOG FUNCTION OVER THE EXECUTIVE BRANCH-THAT IS, THE LEGISLATURE "OVERSEES" THE ADMINISTRATIVE BUREACRACY AS IT EXECUTES THE LAW AND PUBLIC PROGRAMS.

WHERE A SENORITY SYSTEM IS USED, COMMITTEE MEMBERS AND CHAIRS ARE USUALLY RETURNED TO THE SAME COMMITTEE POST EACH SESSIONS, AND LEGISLATURES CAN BECOME REASONABLY INFORMED, IF NOT EXPERT, IN A GIVEN SUBJECT.

1. PROCEDURAL POWERS- DIRECTLY RELATED TO LEGISLATIVE PROCESS

2. INSTITUTIONAL POWERS- CONCERNED WITH ADMINISTRATIVE POLICY AND MANAGEMENT
THE RULES OF THE HOUSE, FORMAL AND INFORMAL, GIVE THE PRESIDING OFFICERS POWER TO:
-APPOINT MOST COMMITTEE MEMBERS
-APPOINT COMMITTEE CHAIRS
-ASSIGN BILLS TO COMMITTEES
-SCHEDULE LEGISLATION FOR FLOOR ACTION
-RECOGNIZE MEMBERS ON THE FLOOR FOR AMENDMENTS AND POINTS OF ORDER
-INTERPRET THE PROCEDURAL RULES WHEN CONFLICT ARRISES
