Def: Admissable Evidence
Information or things which the fact-finder (jury or judge) is allowed to consider when decidng whether a defendant is guilty or not.
5 part to the Evidence Pyramid
Relevant, Reliable, Not unduly prejudicial, Proper foundation laid, Constitutionally gathered.
Def: Direct Evidence
Evidence which proves a fact directly. In other words a witness testifies that he saw, heard, smelled, or felt evidence which goes directly to the defendant's guilt or innocence.
Def: Circumstantial Evidence
Evidence which does not directly show the fact in question but which implies that the fact actually happened.
Def: Substitute Evidence
Evidence which does not to be proved directly or circumstantially because it is a matter of common or "legal" knowledge.
Def: Judicial Notice
Certain facts are usually accepted by the court without actual proof of the facts.
Def: Presumptions
Certian facts are presumed under the law to be true without proof of those facts. These facts can be shown to be untrue by the other side.
