Is it imperative that an Aboriginal person have a support person present during questioning?
If the suspect desires not to have a friend present, the suspect’s statement to that effect must be recorded by the best means available. This situation is not uncommon in indecency offences. There is no case law on the point as yet. However, Police should not impose another persons presence on a suspect who does not desire that person present.
