(i) Unauthorized use by the D of P’s picture or name,
(ii) For D’s commercial advantage, i.e. promotion or advertisement of product or service.

Public disclosure of private facts about the P

(i) Public disclosure of private information about the P,
(ii) Objectionable to a reasonable person of ordinary sensibilities.

Liability may attach even though the actual statement is true.

First Amendment limitations may apply if the matter is of public interest.

First amendment limitations:
If the matter is of public interest, malice on the D’s part must be proved (i.e. with knowledge of falsity or reckless disregard for the truth).
