Is both legal & ethical issue. Informed consent is voluntary permission by client (or proxy) to carry out procedure on client. Can only be given after client receives sufficient info on: treatment proposed, material risk, acceptable alternatives, outcome hoped for & consequences of not having treatment.
Negligence
Omission of an act that a reasonable & prudent person would perform in a similar situation or the commission of something that a reasonable person would not do in that situation.
Describe issues with informed consent in children
An important difference between adults and children that always needs to be included in ethical decisions about child health issues is that children are dependents. They generally are not attributed the right to sel-=determination that is fundamental to adult decision making. The legal system has fixed the age for rational decision making at age 18, but there are some exceptions to this. The difficulty with fixing an age is that it is arbitrary and does not reflect the reality of the individual child’s development. (Catalano 169)
Describe a Living Will
Personal statement of how and where one wishes to die (home, hospice, etc)
Activated only when client is terminally ill & incapacitated
Physician must verify terminally ill
Executing living will does not guarantee its application
Ethical difficulty: when will is formulated, a question of the person’s level of knowledge of potential & future health care problems. Validity is questioned if any indication the person did not understand full implications.
