4th Amendment in General
The 4th Amendment, applicable to the states through the 14th Amendment's Due Process Clause, prohibits warrantless government searches and seizures with limited exceptions.
Motion to Suppress
In order to challenge legality of search/seizure/confession, D must file motion to suppress in writing in Circuit Court within 30 days of earlier of D or counsel's initial appearance.
Standing
To have standing to assert 4th Amend. violation, D himself must have been seized or have a reasonable expectation of privacy in search or seizure.
