MALPRACTICE
Malpractice can be interpreted as "bad practice" and is commonly "professionally negligence".it can be defined as the failure of a professional to use the degree of skill learning commonly expected in that individual's profession, resulting in injury,loss,or damage to the person recieving care.
NEGLIGENCE
Negligence can be described as failure to give care that is normally expected of a person in a particular position, resulting in injury to another person.
ASSAULT AND BATTERY
Assault includes a threat or attempt to injure, and battery includes the unlawful touching of another person without consent.
INFORMED CONSENT
Permission granted voluntarily by a person who is of sound mind after procedure and all risks involved have been explained in terms the person can understand.
INVASION OF PRIVACY
This includes unnecessarily exposing an individual or revealing personal information about an individual without that person's consent.
FALSE IMPRISONMENT
This refers to restraining an individual or restricting an individuals freedom.
ABUSE
It includes any care that results in physical harm, pain, or mental anguish.
DEFAMATION
Defamation occurs when false statements either cause a person to be ridiculed or damage the person's reputation.
SLANDER
An incorrect spoken information.
LIBEL
An incorrect written information.
CONTRACT
An agreement between two or more parties.
IMPLIED CONTRACTS
These are obligations that are understood without verbally expressed terms.
EXPRESSED CONTRACTS
These are stated in distinct and clear language, either orally or in writing.
LEGAL DISABILITY
These are people without legal capacity to form a contract. e.g minors,mentally incompetent persons, individuals under the influence of drugs that alter mental state,and semi conscious or unconscious people.

these are factors of care that patients can expect to recieve.
PATIENT'S BILL OF RIGHTS
these are bill of rights that a patient is entitled to, such as; cosiderate and respectful care,reasonable response to a request for services,privacy concerning a medical care program,confidential treatment of all communications and records, expect reasonable continuity of care etc.
RESIDENT'S BILL OF RIGHTS
this includes the rights residents in long term care ar entitled to under OBRA of 1987, such as;free choice regarding physician,treatment care,and participation in research,freedom from abuse and chemical or physical restraints,privacy and confidentiality of personal and clinical records, accomodation of needs and choice regarding activities, schedules, and health care, voice grievances without fear of retaliation or dicrimination etc.
ADVANCE DIRECTIVES
these are legal documents that allow individuals to state what medical treatment they want or do not want in the event that they become incapacitated and are unable to express their wishes rgarding medical care.
LIVING WILLS
these are documents that allow individuals to state what measurements should or shouldn't be taken to prolong life when their conditions are terminal(death is expected).
DESIGNATION OF HEALTH CARE SURROGATE A.K.A DURABLE POWER OF ATTORNEY(POA)
this is a document that permits an individual (known as principal ) to make any decisions regarding health care if the principal should become unable to make decisions.
PATIENT SELF-DTERMINATION ACT(PSDA)OF 1990
mandates that allhealth care facilities recieving any type of federal aid comply with the following requirements:inform every adult, both orally and in writing,of their right under state law to make decisions concerning medical care, including the right to refuse treatment and right-to-die
provide onfo. and assistance in preparing advance directives
document any advance directives on the patient's record
affirm that there will be no discrimination or effect on care because of advance directives
educate the staff on the medical and legal issues of advance directives.
