Fair Labor Standards Act
The FLSA is the federal law that ensures
wages are paid for all hours worked and that all overtime (OT) hours are properly calculated and paid to employees
Before any work duties are performed outside of an employee's established work schedule,
the employee shall obtain authorization to perform such work
Approval for OT may be granted by
an Assistant Chief (AC) or higher rank level (refer to 1-01.03.401)
Battalion Chiefs (BC) may approve the OT request if
designated by their appropriate AC
Fire Captains may approve overtime for
late alarms (i.e., alarms that come in toward the end of a shift and extend beyond employees’ established work schedule) and related activities
If circumstances prevent an employee from obtaining prior OT approval,
the employee shall contact the AC (or the BC if designated by the AC) as soon as possible following the start of work duties in order to obtain authorization to continue to perform the work
Failure to obtain authorization in a timely manner shall result in disciplinary action
Work-related duties performed during off-duty hours without the appropriate authorization will be compensated, however,
the employee will be subject to disciplinary action for failure to follow required policies and procedures
Work-related duties may include the following:
• Exchanging verbal information at shift change
• Cleaning and maintaining personal protective equipment (PPE)
• Picking up, dropping off, or exchanging PPE or other work-related equipment from HFD facilities
• Performing preparatory work while off duty
• Loading or unloading equipment and cleaning HFD facilities, apparatuses, vehicles, or equipment
• Preparing or completing HFD-related reports
• Relocating from a home station to another station
• Transporting equipment or personnel
• Addressing the public while off duty
• Answering work-related phone calls and e-mails
• Attending HFD-required training
• Attending HFD-required annual physical, fitness for duty, and/or follow-up examinations
This is not an exhaustive list, as this policy covers all types of work performed by HFD employees
Any fraction of an hour of OT worked shall be converted to the nearest

Should there be a conflict between any provision in the FLSA(OT) policy and a provision in the member's CBA,

The Meal Reimbursement Account (MRA) procedures will provide guidance and clarification on the handling of the meal allowances, to ensure that the funds are
managed properly, and to establish a system of accountability for the funds

Meal Reimbursement Account (MRA) check payments shall be made to vendors only, except when
a transfer of funds is authorized by the Assistant Chief of the ASB
Meal Reimbursement Account (MRA) checks shall not be made to
“Cash” or to individual members
When the Fund Custodian of a Meal Reimbursement Account (MRA) changes, the new Fund Custodian shall review the account and submit a Form HFD 24 listing discrepancies found

A Fund Custodian’s signature block shall be printed under the statement and the Fund Custodian shall sign the statement

Scholarship applicants shall submit a letter, which shall include the applicant’s academic field and its applicability to the operations, management, and administration of the HFD, to
the AC of Support Services.

Personnel transferred or promoted to Fire Fighter III (Emergency Medical Technician) in the Medical Section shall serve a minimum of
three years in the section.

Any member who is notified of the death of an active or retired member of the Department shall

the ASB.
Serious illnesses and injuries that result in the hospitalization of a member, whether they occur on or off duty, shall be immediately reported to the appropriate
Company Commander or Battalion Chief, who shall notify the Fire Chief or Deputy Fire Chief via the ASB.
If a member needs to extend a previous authorized absence, he/she shall submit a new Physician’s Certificate to his/her Battalion Chief within
five (5) calendar days from the last authorized day of absence.
If a member fails to submit a Physician’s Certificate within five (5) calendar days from the last authorized day of absence, in lieu of Sick Leave,
he/she shall be placed on Vacation Leave or Leave Without Pay (if no vacation is available) for any workday or work-shift that falls within the five-day grace period and then on unauthorized leave of absence (Leave Without Pay) thereafter.
Before a scheduled work shift __________________ and before taking sick leave, the member shall notify his/her Bureau Head or Battalion Chief, who shall notify the Company Commander.

Members who fail to keep their licenses and/or certifications current for reasons such as, extended Accidental Leave, Sick Leave, Military Leave, and Leave Without Pay shall request authorization to return to duty through the
Battalion Chief of the Safety and Health Office prior to returning from an extended leave.
The Safety and Health Officer shall make arrangements to provide recertification for the member and the Department shall assign the member to
the Training and Research Bureau for the duration of the training.
All uniformed personnel below the rank of Fire Captain are also required to annually meet the driver training requirements and to be
City certified.
Completion of the annual medical evaluation and possession of a valid Medical Examiner's Certificate are required of all
Category A or B license members.
If a member’s state of Hawaii driver’s license is revoked for any reason, the member shall comply with the following:
1) Notify his/her supervisor immediately of the revocation of license.
2) The supervisor shall verbally notify the Fire Chief and the Apparatus Operation section (AOS) as soon as possible through channels by the end of the next working day or shift, as applicable. The supervisor shall immediately submit an HFD 074 form through channels from the involved member to the Fire Chief.
3) The member shall report to the AOS at 0800 hours the next working day or shift, as applicable, with all available documents.
4) The member shall keep the AOS apprised of further developments through proper channels.
5) The AOS shall make copies of all documents, record statements, and submit a report to the Fire Chief regarding the status of the member.
6) The member may remain on duty if a valid temporary license/permit or conditional permit is in his/her possession.
Revocation of license for a period not exceeding one year shall result in the member being placed on
Leave Without Pay (LWOP) status from the Department.
Revocation of license for a period of more than one year shall result in the individual being
terminated from the Department.
A member arrested for DUI shall notify his/her immediate supervisor on
the next working day or shift, as applicable. The supervisor shall verbally notify the Fire Chief and the AOS as soon as possible through channels by the end of the next working day or shift, as applicable. The supervisor shall immediately submit an HFD 074 form through channels from the member to the Fire Chief.
If a member successfully obtains a temporary license and/or a conditional driving permit (to drive to and from work and within the scope of the member’s duties),
the member may be allowed to return to work.
