Antiquities Act

1906. Prohibited destruction/disturbance of any monument/site of antiquity on Fed land. Didn't apply to state or private property, treated as land management (not cultural protection) issue, lax enforcement, penalties not harsh enough.

1938. Explains what the Antiquities Act mandates. Requires submission of a catalog collection, any items collected w/o permit become property of Sec. of the Interior. Collections must be preserved in public museum. First to deal with more than just land.

1935. Formation of Nat'l Historic Landmarks Program. Gave Nat'l Park Service authority to carry out preservation. National survey to find important sites. Reaction to restoration of Colonial Williamsburg.

1960. Formalized designation of National Historic Landmarks (defined as: historic building, site, structure, object or district that represents an outstanding example of American history and culture)

1960. First legislation specifically re: arch. Written to expand on Historical Sites Act. Intended to ensure arch. investigation and salvage operations beginning at planning stages.

National Historic Preservation Act (NHPA)

1966. Expanded Fed. protection to sites with local or regional importance (but more local groups should manage them). Gave money to fund state arch. surveys (MN 1977) and for site preservation. Est. National Register of Historic Places (eligibility: age, integrity, significance). Established SHPO and duties. Section 106 ("compliance work").

Archaeological and Historic Preservation Act (AHPA) AKA Moss-Bennet/Arch. Recovery Act

1974. Expanded protections of Res. Salvage Act to all construction projects. Regulates how and where things must be stored. Amount set aside for archaeological projects can't be more than 1% of the total budget.

Archaeological Resources Protection Act
|
1979. Follow-up to the Antiquities Act. Defines archaeological resources (>100 years old), permitting for excavation on public land, curation requirements, increased penalties for violations.
