Unlawful Restraint (Class A)
A person commits an offense if he intentionally or knowingly restrains another person. Affirmative defense: 1) person restrained was a child younger than 14 2) actor was a relative of the child 3) actors sole offense was to assume lawful control of child
Unlawful Restraint (SJF)
Person restrained was a child younger than 17 years old of age
Unlawful Restraint (3rd degree)
1)The actor recklessly exposes the victim to a substantial risk of serious bodily injury 2) The actor restrains an individual the actor knows is a public servant while the public servant is lawfully discharging an official duty. Affirmative defense to prosecution 1) the person restrained was a child who is 14 years of age or older and younger than 17. 2) the actor does not restrain the child by force, 3) actor is not more than 3 years older than the child.
Kidnapping
Intentionally or knowingly abducts another person. 3rd degree
Aggravated Kidnapping
Intentionally or knowingly abducts with intent to 1) hold for ransom 2) use as shield or hostage 3) facilitate the commission of a felony 4) inflict bodily injury or violate or abuse sexually, 5) terrorize, 6) interfere with political function 7) deadly weapon - 1st degree felony
At punishment stage person may raise the issue of whether he voluntarily released the victim in a safe place, if proved then 2nd degree felony.
