What is an Intentional tort? What are Examples of Intentional Torts?
Intentional torts are when the defendant intended to harm the plaintiff. Examples are:
1.Assault and Battery
2.False Imprisonment
3.Trespassing
4.Conversion
What are Unintentional Torts? What are some examples?
Unintentional Torts are when there is behavior which is compared to an objective standard of conduct. Examples are:
-Medical Malpractice
-Product Liability
-Automotive Accidents
-Landowner liability
-Injuries caused by escape of wild animal
Intentional Torts require a state of mind and Conduct which invades the interest of others. What are forms of state of mind?
-Purpose: Desire to bring about a consequence
-Knowledge: Knowing that a consequence will come from action
-Recklessness: Gross deviation from standard of conduct where actor is aware of risk
-Negligent: Deviation from standard of conduct where the actor is not aware of risk
