Substantive due process - Asks whether the government has an adequate reason for taking a person’s life, liberty or property. Looks for adequate substantive justification for the government’s action b. Used in 2 areas i. Economic liberties ii. Privacy.


Procedural due process - has there been a deprivation of life, liberty, or property? 5th Amendment.

Equal protection - The equal protection clause of the Fourteenth Amendment applies only to state and local governments 1. Fourteenth Amendment never applies to federal govt ii. Equal protection is applied to the federal government through the due process clause
of the Fifth Amendment iii. The level of equal protection is the same under the 14th or the Fifth Amendment whatever level the government, it is just the authority from the Constitution that is different
