Prior Restraint
Censorship imposed before a speech is made or newspaper published. usually presumed to be unconstitutional
Unprotected speech
Libel, obscenity, fighting words, and commercial speech, which are not entitled to consitutional protection in all circumstances
Libel
Written defamation of another person.
Fighting words
Words that by their nvery nature inflict injury on those to whom they are addressed or incite them to acts of violence.
Commercial Speech
Advertisements and commercials for products and servicses. They receive less first amendment protection, primarily to discourage false and misleading ads.
Civil Disobedience
Deliberate refusal to obey a law or comply with the orders of public officials as a means of expressing opposition
Property rights
the rights of an individual to own, use, rent, invest in, buy, and sell property
eminent domain
power of government to take private property for public use. constitution gives governments this power but requires them to provide just compensation.
regulatory taking

(1973) - Right to privacy about abortion. 3 trimester rule. 1st women has right to privacy, goes fromt here.
Planned Parenthood v. Casey
(1992) - reaffirmed roe v. wade. got rid of the trimester rules and gave states powerto make regulations on it.
search warrant
allows police to search a house, must have probable cause.
Exclusionary rules
requirement that evidence unconstitutionally or illegaly obtained be excluded from a criminal trial
Miranda v. Arizon
(1966) - gave suspects tons of rights.. right to remain silent all that jazz
grand jury
12-23 people, privately hear evidence presented by government determining whether perople should be required to stand trial
Petit jury
-12 people determining guilt or innocence in a civil or criminal action
Indictment
formal written statement from a grand jury charging an individual with an offense - true bill
Double jeopardy
Trial or punishment for same crime by same government forbidden by constitution
Civil Rights
rights of all people to be free from irrational discrimination such as that based on race, religion, gender, or ethnic origin.
Natural Rights
Rights of all people to dignity and worth, also called human rights
Affirmative action
Remedial action designed to overcome the effects of discrimination against minorities and women
Naturalization
Legal action conferring citizenship on an alien
