Active Listening

The process of signaling that you are really listening, accomplished by using verbal and nonverbal clues, paraphrasing, and reflecting the client's feelings.

Open questions

Broad questions that put few limits on the freedom of he respondent.

Closed questions

Specific questions that usually demand very short or yes-no answers.

Hearsay

Someone in court testifying to what someone said out of court for the purpose of establishing the truth of what was said.

Retainer agreement

A contract that outlines the attorney's duties and the client's obligations regarding payment, on either an hourly or a contingency fee basis, as well as the client's responsibility regarding costs and expenses.

Lay witness

A witness who has not been shown to have any special expertise.

Expert witness

A witness who possesses skill and knowledge beyond that of the average person.

Hostile witness

Also known as an advese witness; witnesses who show bias or hostility toward the party that asked them to testify.
