Civil Rights Act of 1866
All citizens of the U.S. shall have the same right in every state and territory as is enjoyed by white citizens thereof to inherit, purchase, lease, sell, hold, and convey real and personal property.
1968 Fair Housing protected classes

Jones v. Mayer - 1968
prohibits all racial discriminination, without exception.
Important because it prohibited racial discrimination in the sale or rental of privately held property.
federal fair housing exemptions
-owner occupied buildings with no more than 4 units
-single family housing sold or rented w/out the use of a broker
-housing operated by organizations and private clubs that limit occupancy to members

The sale or rental of a single-family home:
-the home is owned by an individual who does not own more than 3 such homes at one time (and who does not sell more than 1 every 2 yrs)
-a real estate broker or salesperson is NOT involved in the transaction
-discriminatory advertising is not used.
