Ladies and gentlemen of the jury, I am here today to prove the innocence of my client, Tom, against the charges of attempted murder. My client is being tried unfairly just because he is the bigger animal and the suspected predator; however, through a series of evidence I will show you that it is in fact Jerry who is to blame for the conflicts between the two and Tom is the real victim of murder.

To start off, my client just tries to mind his own business, but is always interrupted by Jerry the mouse. According to Jerry the Mouse page from villains.wikia.com, “In a number of episodes, Tom is tasked with doing something (or not doing something) by his owner or he will be kicked out of the house, and Jerry will go out of his way to get Tom into trouble, even when Tom has yet to do anything to him in the episode”. One specific episode is The Million Dollar Cat, where my client inherited a million dollars, but would lose the money if he did anything wrong against another creature.

According to villains.wikia, “ Jerry brutally exploited this, constantly tormenting Tom and making him utterly miserable solely for his own amusement”. Tom did nothing at all to try and hurt Jerry, yet the mouse will do anything in his power to make himself a target. My client is the one who is being made miserable in the relationship between these two. Just because Jerry is smaller, doesn’t make him innocent. My client is assumed to be the villain just because he is a cat.

My next point is that not only does the mouse try and stir up trouble, he inflicts pain on my client. One example of this is in the episode Rocking House Tom. According to the Tom and Jerry wiki, Tom’s owner is being harassed by Jerry and she calls to Tom for protection. He chases the mouse away from his owner like an obedient cat, but causes no harm to the mouse. Jerry continues to traumatize Tom’s owner and then causes “the ironing board, along with the iron, to fall on Tom’s head”.

My client was just doing his job by providing defense to his owner and he ended up with injuries from heavy objects falling on his head. Tom did not instigate anything with Jerry, yet he ends up with the injuries while the mouse gets away unharmed. Jerry just doesn’t harm Tom, but he caused emotional damage to Tom’s owner for fun. Many post-modern audiences have taken more and more notice to the brutal injuries that Jerry regularly inflicts on him, and sympathize more with Tom because they see who the real bully is.

Not only does Jerry inflict pain onto my client, but he turns others against the poor cat. Jerry’s favorite sidekick to use is Spyke, a ferocious bulldog. According Tom and Jerry Wiki, the episode titled “Hic-cup Pup” recalls an event in which Jerry causes Tom to get on Spyke’s bad side. Spyke threatens Tom to be quiet while his son, Tyke is sleeping; however, Jerry makes sure that Tom disobeys Spyke’s orders: “Jerry immediately bites Tom's tail, who screams in pain, waking up Tyke a second time”.

Not only did Jerry inflict physical pain once again, Tom will now have to deal with Spyke who is much bigger than he is. My client has been teamed up against as a result of Jerry’s actions and constantly feels victimized. Not only has Tom suffered abuse from the mouse, but from others. Nobody should take pity on Jerry because he is a small mouse, for he has connections that make up for his size.

My last and most powerful point is the fact that in all of the episodes, Tom never kills Jerry. But, in the episode titled the Two Mouseketeers, Tom was decapitated as a result of Jerry’s actions and according to the Jerry page from Villains Wiki, “Jerry showed no pity nor remorse”. The chasing between Tom and Jerry was usually just a game, but Jerry took it to a whole new level. He actually succeeded in killing Tom and didn’t feel the slightest bit of sadness showing how evil he is. Therefore, I think this claim overpowers the charge of attempted murder against Tom since Jerry actually slaughtered my client.

I would now like to call my client, Tom to the stand.

Do you ever feel as if Jerry intentionally instigates issues between you?Yes, I constantly feel as if he starts conflicts just for the sake of it. For example, whenever my owner wants to me to do something, I always want to be a good house cat and obey. However, Jerry will always go out of his way to frame me and make me look bad. I would love to just sleep all day, but Jerry is always there to stir up trouble with either me or my owner.

In what ways has this mouse tried to hurt you?


A: I have been bit, hit, objects have fallen on me...the list goes on and on. The worst is when Jerry teams up with Spyke who is much bigger than me. Jerry knows how to make sure I get extremely injured and will go out of his way to ensure this happens.

Q: Jerry will most likely bring up some incidents of conflict, so you believe these are out of self-defense? A: I do. I am usually minding my own business when the mouse starts conflicts. Do not be fooled by his small size, for I have been attacked and feel the need to fight back in order to prevent any further injuries. When we fight, it is back and forth, so I do not think it is fair that I get all of them blame when I am hurt just as bad or even worse. I’m also trying to protect my owner since Jerry finds it amusing to mess with her. All I want to do is my job, but none of this would be necessary if Jerry didn’t make the first move.

If you were to just be left alone, what would life be like for the two of you?A: I would love to be at peace with Jerry and not have to fight anymore. The only times I would chase him would be to defend my owner and make her happy, but I would never want to cause any harm to him. If Jerry would leave the both of us alone, there would be no issues and we could both enjoy our separate lives without pain. The two of us may even be able to work together. I would like Jerry to recall the time when he was being attacked by an ally cat and I rushed in to save him in the episode The Truce Hurts. Without me, Jerry may not have made it out alive.

Why do you continuously start fights with Tom and terrorize his owner, even when he is doing absolutely nothing to you?


Why would you pick on Tom, who you know is much bigger and stronger than you and then play the victim?


Why would you want to put yourself in this situation of danger when there can be peace?


According to epsiode the Three Mouseketeers, you actually caused Tom to die. How can you defend yourself against this when there is solid evidence in the episode that you were the reason he was killed?

I hope it is extremely clear that it is Jerry who is to blame for the situation, and not my client. The evidence that I addressed previously and the interviews as well as the cross examination show that Tom is the true victim and should not be falsely charged for attempted murder. Not only does Jerry instigate trouble, he is constantly inflicting pain on my client and others. Tom has only defended himself and his owner against Jerry’s constant attacks.

If anything, Tom has been a protector to society, not a threat. His poor owner has been traumatized by Jerry’s antics, and Tom has taken the injuries in order to protect her.

Yes, Tom and Jerry have had their fights and conflicts, but these could all come to an end if Jerry didn’t enjoy starting trouble so much. The mouse will do the same things as my client, except when Tom does them it is considered attempted murder. This is extremely unfair and based off of appearance. Because of the stereotypical belief of the mouse is the victim and the cat is the bully, Tom is having to deal with these unjust charges against him.

According to Villains Wiki, “While Tom is widely considered by default to be the "villain" between the two, many post-modern audiences have taken more and more notice to the brutal injuries that Jerry regularly inflicts on him, and sympathize more with Tom”. The general public is not starting to see who the real bad guy is in the situation, and I hope you all realize this as well

Jerry also gets others, like Spyke, involved when the conflicts should stay between Tom and Jerry if there are any. This only creates even more conflicts which shouldn’t even exist just because Jerry gets enjoyment out of it.

Some may argue that Jerry needs the defense of a dog, but from previous evidence I have showed that the mouse is a vicious fighter on his own and is capable of causing harm to others despite his size. Jerry is teaming up against this unfortunate cat with an animal who is much more aggressive and ferocious. The mouse is spreading the seed of violence to others which is making him even more of an instigator and a danger.

The world is not safe while this terror of a mouse his running around. Jerry has used the fact that he is a mouse and Tom is a cat to try and gain sympathy, but no pity should be taken. This mouse has caused more damage than many others that are more than one hundred times his size. He even has a page dedicated to him on Villains Wiki which shows how evil this little mouse can be.

I am disgusted by the fact that Jerry is here today in hopes of trying my client for attempted murder when he is the one who has caused all the problems. Not only that, but Jerry has successfully killed my client in the past. Tom may chase Jerry around, but he has never caused that serious of damage to him. It is unjust that Tom is being tried for attempted murder by his own killer.

It is now up to the jury to decide the fate of this poor cat who has been misjudged and criticized when all he wants to do is his job and please his owner. Tom has had to suffer through years of being the suspected bully when it is really the other way around. So please, I hope you all have listened carefully to the evidence that I have provided and can see that Tom does not deserve this accusation.

I would like to thank judge Conroy and the jurors for listening to this case and for hopefully making the right decision. Tom deserves to be found innocent of this crime because Jerry starts the conflicts, he has received numerous injuries due to abuse from the mouse and even ended up dead in an episode. I hope the final decision will reflect this.
