AG v Hamilton (No 1) 1993

AG objected to Beef Tribunal trying to question former Minister about cabinet discussions. SC accepted such were absolutely confidential because fulfilment of duties under Art 28.4 requires full free and frank discussion

1997 amendment

Art 28.4.3 - allows for exceptions to judicially enumerated cabinet confidentiality - interests of administration of justice, overriding public interest x

Howlin v Morris

Howlin tried to assert privilege over allegations made to him about behaviour of certain Gardai. Held 15.10 not self-executing and privilege must be according to actually made rules and SOs

Garda Representative Association v Ireland

Applicant said min for justice had given certain undertakings in the Dail. Art 15.13 engaged and held could not sue if statements would be used as some evidence

Ahern v Mahon

Bertie tried to stop examination of statements he made in the Dail and use against him before Mahon Tribunal. Held he could not be cross-examined regarding inconsistency but statements could be recorded in report

Murphy v Dublin Corporation

Court would decide whether or not matters enjoyed cabinet confidentiality - cabinet could not assert without being amenable to judicial review
