First Amendment
Guarantees the freedoms of religion, speech, and the press and the rights to assemble peaceably and the petition the government
Second Amendment
States that the right of the people to keep and bear arms shall not be infringed
Fourth Amendment
Prohibits unreasonable searches and seizures of persons or property
Fifth Amendment
Guarantees the rights to indictment by grand jury, to due process of law, and to fair payment when private property is taken for public use; prohibits compulsory self-incrimination and double jeopardy (being tried again for an alleged crime for which one had already stood trial)
Tenth Amendment
Establishes that those powers neither delegated to the federal government nor denied to the states are reserved to the states and to the people.
Fourteenth Amendment
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
Police Powers
They are state regulatory powers. The term does not regulate solely to criminal law enforcement but rather refers to the broad right of state governments to regulate private activities to protect or promote the public order, health, safety, morals, and general welfare.
Due Process
Has 2 aspects - Procedural and Substantive. Note that the _ clause applies to "legal persons" (that is, corporations) as well as individuals. Fair and equal process of the law in the constitution.
Equal Protection
Applicable to the federal government as well. _ means that the government cannot enact laws that treat similarly situated individuals differently
HIPAA
No one can have medical records unless they have the consent from the individual.
Patriot Act
Putting two agency's together = Homeland Security. FBI and CIA can pass there information through Homeland security, and they can put the information together. Both Republicans and Democrats liked it which means its a BAD IDEA.
Class Action Suit
Like Gillette claiming they have the closest shave, and people sign a petition that it is false advertisement, and they get some money.
