ASPPB Code of Conduct purpose
|
Constitutes the standards against which the required professional conduct of a psychologist is measured.
|

ASPPB Code of Conduct scope
|
Covers the provision of any psychological services in any context but doesn't supersede state, federal law. Does supersede APA ethics code.
|
|
ASPPB Code of Conduct violation
|
= unprofessional conduct for which you can be disciplined (mentions failure to be licensed or have license renewed)

Limits on practice
|
Must limit practice and supervision to areas of competence in which proficiency has been gained through education, training, and experience
|
|
Maintaining competence
|
Must maintain through continuing ed, consultation, etc
|
|
Accurate representation
|
Must accurately represent areas of competence, education, training, experience, and professional affiliations to the board, the public and colleagues

|
Adding new services and techniques
|
When developing competence in something that is new or new to you, engage in ongoing consultation with other psychologist or relevant professional and seek appropriate education and training. Inform clients of the innovation nature and known risks associated with the services so they can exercise freedom of choice
|

Referral
|
Make them when asked or if you believe they could benefit (clearly in their best interest)
|
|
Sufficient professional information
|
If you render a formal opinion about a person, you can't do so unless you have had substantial and direct professional contact with or made a formal assessment of that person
|
|
Maintenance and retention of records
|
Should include: name and other identifying info; presenting problem, purpose, diagnosis; fee arrangement; date and substance of each billed or service count contractor service; test results or other evaluative results obtained and any basic test data from which they were derived; notation and results of formal consults with other providers; copy of all test or other evaluative reports prepared; any releases. Must be kept at least 5 years or longer if reqd by law (6 in OK).

Supervision records
|
Maintain for five years after the last date of supervision a record that includes type, place, and general content of the supervision.

|
Continuity of care
|
Have someone available for client emergencies during your absence; good to have a professional will, too
|
|
Delegating professional responsibility
|
Don't delegate responsibilities to a person not appropriately credentialed or qualified
|
|
Multiple relationships
|
May occur due to previous or present familial, social, emotional, financial, supervisory, political, administrative or legal relationship with clients or their close associates. Okay so long as not exploitative, risk of harm, or cause you to lose your objectivity. Proceed with care.

Sex with clients
|
Is a very bad thing. Can't have sex with current clients, close relatives, etc of current clients. Can't end therapy in order to have sex with a client. Can't accept into therapy former sexual partners. Can have sex with a former client after 24 months but not if they are vulnerable to exploitative influence.

|
Impairment
|
If you know you're impaired due to mental, emotional, physiologic, pharmacological, or substance abuse, terminate appropriately (or suspend/limit), notify the client in writing, and assist them in finding new services.

Explanation of procedure
|
Give a truthful, understandable, and appropriate account of the client's condition and keep them fully informed as to the purpose and nature of any evaluation, tx, or other procedure and of their right to freedom of choice concerning services provided.
|
|
Termination of services
|
Whenever feasible, offer to help locate alternative sources of professional services or assistance when indicated. Terminate when they're not benefiting. May terminate when threatened.
|
|
Solicitation of business by clients
|
Don't ask your clients to help you drum up business
|
|
Welfare of subordinates
|
Duty to protect the welfare of supervisees, research participants, and students. No very or physical behavior that is seductive, demeaning, harassing, or exploitative. Respect dignity and comply wit hall relevant statutes.

|
Disclosure w/o informed written consent
|
* When it is necessary to protect against a clear and substantial risk of imminent serious harm
* Limit disclosure to only those persons and only that content necessary to address the problem * Comply w/ court orders |

Services involving more than one interested party
|
If more than one person has an appropriate interest, clarify at the outset the dimensions of confidentiality and responsibility. Specifically indicated when the client is an organization.

Multiple clients
|
When providing services to more than one person (couples, families, groups) clarify at the beginning how confidentiality will be handled. All parties must be given an opportunity to discuss and accept limitations of confidentiality.

|
Legally dependent clients
|
At the beginning of services, to the extent that a client can understand, inform them about confidentiality and who will be getting what information
|
|
Limited access to client records
|
Protect confidentiality of records and limit access to them. Assure that all other employees comply with requirements for confidentiality.
|
|
Discussion of client information among professionals
|
When part of a team or seeking consultation, can share confidential information if you take reasonable steps to assure that all who hear what you're saying know it's confidential and treat it as such.

|
Disguising confidential information
|
When using cases for teaching, research, publication, make sure the info is appropriately disguised to prevent client identification.
|
|
Observation and recording
|
Must have written consent.
|
|
Display of license
|
Needs to be up and available on the premises of the office
|
|
Reasonableness of fee
|
Shall not exploit the client or payor by charging a fee that is excessive for the services performed or by entering into an exploitative bartering arrangement in lieu of fee
|
|
Communication of assessment results
|
Explain results in an understandable way using interpretive aids and explanations
|
|
Reservations concerning assessment results
|
Include in the report which norms are available, any deficiencies of those norms related to the client and any other reservations which might affect validity, reliability or other interp.
|
|
Misrepresentation of services or products
|
Don't associate or permit use of your name in connection w/ services or products is such a way as to misrepresent the service or product, misrepresent your degree of responsibility for them, or the nature of your association with them
|
|
Information for professional users of assessments
|
Accompany them with a manual or other material which fully describes the development, rationale, evidence of validity and reliability, and characteristics of the norming sample. Explicitly state the purpose and application for which the procedure is recommended and identify qualifications necessary to administer and interpret.

|
Providing information to clients regarding violations and how to report them to the Board
|
If you learn of a violation from a client or if they ask how to report someone, you're obligated to inform them of standards of practice and how to file a complaint with the Board.
