What are the complaint proceedings described under the ACT?
A person makes a complaint against a registered member. They can do this up to five years after a member has been suspended or cancelled their registration under the act.

A preliminary investigation is performed first and the registered member is obliged to cooperate with this.

At the conclusion the complaint is either struck off or referred to be investigated by the committee.

The committee will review evidence and speak with the complainant and the investigated person.

The registration of the person can be temporarily suspended pending the review.

A hearing will then take place.

Following the hearing the committee can make orders to reprimand or suspend.

Fines, costs and training / remand work to correct a problem can be designated with suspensions temporary and permanent depending on findings.
Timescales for reviews and disciplinary actions
If no further action will be taken the complainant has 30 days to request a review.

No less than 30 days before the hearing is due the investigated person must receive a copy of the complaint.

Appeals against an order must be received no more than 30 days after the date on which the decision is served.

If the registration has been cancelled or suspended the board must hear the appeal within 30 days of receipt.

If not suspended then hear the appeal within 90 days.

No extension to this may be for more than 90 days.

Have 30 days to appeal a decision to the court of appeal.
