Constitutional Law
The highest form of law in this country; based on the US constitution and the state constitution and on judicial interpretation of these documents
Statutory Law
Consists of the states (laws) enacted by legislative bodies including the US congress the CA legislature, the people, and city counsels and other local legislative bodies
Administrative Law
is composed of the rules, orders, and regulations issued by federal, state, or local executive officers acting under proper constitutional and/or statutory authority
Common Law
Unwritten judge made law that has developed over centuries from those generally accepted ideas of right and wrong that have gained judicial recognition, it covers nearly all aspects of human conduct.
Equity
it supplements common law, developed to provide equity- Fairness, Justice, and right- when remedies under the common law fell short of that goal. Seeks to stop obvious wrongs before it occurs
Injunction
A court order that forces or limits the performance of some act by a private individual or by a public official
Civil Law
The portion of the law relating to human conduct, to disputes between private parties and to disputes between private parties and government not covered by criminal law
Criminal Law
The portion of the law that defines public wrongs and provides for their punishment
International Law
Involves the treaties and agreements among nations with decisions being made in international court
Adversary system
When two sides of a dispute argue before an unbiased jury and a neutral judge
Presumption of Innocence
you are presumed innocent until proven guilty
Ex post Facto
no person shall be punished for an act which is not a crime at the time it was committed
Habeas Corpus
Forces law enforcement to present a prisoner and show proof why they should be detained
