Staff may, at any point, determine the situation can be resolved without the use of an extraction team and terminate the process (i.e., removals for court appearances, housing relocations, contraband recovery, etc.).

The Unit Commander shall be notified of all Calculated Extractions prior to the extraction commencing. This notification shall be documented in the Watch Commanders’ Incident Analysis/Overview. In the event the Unit Commander is not available, the cell extraction may proceed at the Watch Commander’s discretion, and the attempt to notify the Unit Commander shall be documented as noted above.

Officers intending to interrogate an inmate must check to see that he has not invoked his Miranda “right” to counsel within the past 14 days, to any officer, on any case. Maryland v. Cell extractions fall into two categories :

Calculated: Calculated extractions occur in situations where an inmate is in an area that can be isolated or controlled. It does not normally involve an immediate threat to loss of life, substantial loss of property, or institutional security. Calculated extractions may only be authorized by the Watch Commander. Staff may, at any point, determine the situation can be resolved without the use of an extraction team and terminate the process (i.e., removals for court appearances, housing relocations, contraband recovery, etc.).

During a patdown search of a subject, a Deputy feels an object within a baggie in the subject's pant pocket. After manipulating the object, the Deputy determines the object is not a weapon, but is dope. The Deputy arrests the subject for possession of a controlled substance.

Is this a valid arrest ?
No.

A patdown (Terry Search) for weapons is only allowed if one can articulate specific facts that the subject may pose a danger to the officer. The removal of other "contraband" from the subject's pocket is only warranted if one can articulate the object was "immediately apparent" as a specific item of contraband. In this case, the Deputy made the determination of the nature of the contraband only after manipulating the object (placing it outside of the scope of a Terry weapons search).

The deputies knew the house was a “known Crip gang hangout.” The front yard had a four-and-one-half- to five-foot high wrought-iron fence. There was a gate in the middle of the fence which allowed access to the front door. The deputies did not know the defendant or the other two men.
The defendant looked at the deputies, turned and quickly walked to the front door of the residence. When the defendant turned, one deputy saw the butt of a chrome and black handgun in the defendant’s left, rear pants pocket. The deputy ran after the defendant. The defendant entered the house and slammed the front security door.

The Court declared that the fenced front yard, in this particular case, based on the totality of the circumstances, was not a public place within the meaning of Penal Code section 12031.
Thus, the defendant was not carrying a firearm in a public place, the officer lacked reasonable suspicion of criminal activity justifying a detention, and the officer’s entry into the house could not be based on exigent circumstances.
