Introduction
The 18 U.S.C § 371, insists that the charge of criminal conspiracy holds if an individual agrees or plots with another to commit an act that if achieved, will be an offense to the law and of itself, It is difficult to determine the crime of conspiracy as it usually entails a verbal agreement between or among persons boiling down to the “he said”, “she said” argument which all depends on the credibility of involved persons (Mustain 1). However, it is assumed that two people conspired to commit a crime if the two are involved in the criminal act. The following paper will argue that John Gotti should be charged for conspiracy to commit murder of three victims in relation to the law on conspiracy.
