On Thursday, 10/22/2015, at about 6:00 a.m., Claimant Gomez allegedly reported to work pain-free. The claimant stated he was not under a doctor’s care or taking any prescribed medication when he reported for work as a Park Maintenance III employee.

The claimant stated that he worked with Mr. Shane Thompson and Mr. Richard Gomez, two coworkers with whom he works on a daily basis with. They were assigned to work at the city yard at 809 North Angelino Street, Azusa, CA 91702. Their assignment at the city yard was to work on the second floor of a building where they started at about 7:00 a.m. Their aim was to clean out the storage area on the second floor to make room for other equipment. He stated he would pick up the plywood and carry it across his body stacking the sheets on a nearby pallet. The claimant alleges that he performed this same routine about four times when he noticed that his right shoulder began hurting, and he felt a burning sensation. He immediately informed his coworker, Mr. Shane Thompson, that he was no longer able to lift anything else as his coworkers finished their rest of their task on the second floor.

The claimant alleged after they were done cleaning the storage facility at the city yard, he was instructed by Supervisor, Mr. Ross Montes, to pick-up a city stake bed truck at another site within the city and to drop it off at the Azusa City Yard for an upcoming auction.

The claimant alleged that when he was driving the stake bed truck, the truck ran out of gas. Mr. Montes came to his aid and decided to tow the truck by attaching a chain to the stake bed truck utilizing his truck and after driving the stake bed truck to the city yard as the claimant’s vehicle. The claimant stated as he attempted to steer the stake bed truck that had no gas and no power steering. In doing so, the claimant alleged he felt his right shoulder that he had injured early started to become more painful than before. He called the city nurse at a 1-800 number for “precautionary measure.” After speaking with the nurse, the claimant alleges that he was told by the company nurse to ice his right shoulder and to take Motrin. He was not referred for a medical evaluation at the city’s medical clinic in Irwindale, CA.

The claimant stated he reported to work on 10/23/2015. He continued to ice his right shoulder and take Motrin after his alleged 10/22/2015 incident. He said he continued to work after his alleged DOI: 10/22/2015 as he continued to work with having pain to his right shoulder each day, until 10/29/2015. The claimant estimated his pain level between a one through a ten as ten being the worst, was an “eight.”

On 10/29/2015, the claimant alleged when he was at work performing his normal duties at City Yard when he felt the pain in his right shoulder that traveled to the right side of his neck.
