Homicide Since the beginning of human kind, humans have been immoral. Messing up is part of our DNA as the human race. One of the most horrid acts that civilized humans have outlawed is the act of homicide. Homicide is the deliberate and unlawful killing of one person by another. Homicide, or murder, has been around as long as the story of Cain the farmer and his brother Abel the shepherd, the first and second sons of Adam and Eve. A lesson of history is that wrongfully killing thousands to millions of people rarely solves anything worth the cost of the lost human life. Homicide is a problem in our society to this very day. It is gruesome and intrinsically wrong. We as an intelligent species have an inborn right to life. No one is truly better than anyone else, although some think otherwise. As equals it cannot be tolerated that one kills another contributing member of society who is for all intents and purposes not truly hurting anyone. The fact of the matter is, although we are equal, everyone is different and come from different backgrounds that do not allow for equal opportunity. Sometimes there are hiccups in the production of human life. Genes get misconstrued, trauma occurs at a young age, or a person can get bent on something as psyche crushing as revenge. Humans have known this without the microscopic science for a very long time. Uncorrupted members of society always just know that killing is wrong. Killing someone for no reason has always been illegal in the United States. With the advances in modern science, in the United States there have been changes and exceptions in the judicial system allowing some accused murders to have a deemed legitimate defense instead of being put to death or jailed in federal prisons for the rest of their …show more content…
When defending first degree murder there are several ways they defend the defendant. One of which, and the most common, is the justifiable homicide defense which is legally justified. Secondly, the self-defense argument (criminal.findlaw.com). The defendant must show that they were in danger of death or harm. The defense of others (criminal.findlaw.com) defense goes hand in hand with the self-defense argument. The only difference is the threat of death or harm is on another person. The exercise of duty (criminal.findlaw.com) defense comes into play when an officer kills a person without devious intentions. For example, if an officer shoots and kills a man who has shot three people and is holding another hostage, the officer would use the exercise of duty defense and rightfully not get into trouble. As society has grown, there have been more and more ways that an accused person in a murder case can defend themselves. These defenses can be a very good thing for civilization. It allows the falsely accused a hope of seeing the light of day again, a just courtesy that was not often given two hundred years ago. Also, it helps put the mentally insane in their allotted place. There is always another side. Society’s solutions and laws are not perfect. Sometimes these defenses that have helped so many help the guilty go free on minor technicalities or a convincing lawyer that is simply doing
