United States Court Case Study

In the United States the courts have a particularly important role to play. Our Constitution is based upon the idea of limited government. The judicial branch has been given a major responsibility for seeing that government does not exceed the powers the people have given it. The states have their own court system, and since the US Constitution is the supreme law of the land, any case involving federal law or the federal Constitution is heard in a US court rather than in a state court. The Supreme Court of the US exercises the power to void laws passed by state legislatures and to overrule decisions of state courts when it deems these laws or decisions to be in conflict with federal law or the US Constitution.

    I too think that having a gun on school grounds is a serious crime. In the case of United Sates v. Lopez it should have only been up to the state to punish him, but that wasn't the case. Lopez's crime should not have been punishable under the Commerce Crime and that was exactly what the ruling upheld. The Commerce Crime had nothing to do with the Gun Free School Zone Act and therefore it was unconstitutional. Great discussion.…
