Upon arrival I met with Walmart loss prevention employee/ witness Marion Edwards. Marion advised he observed the defendant, later identified as John Szatkowski, select a pair of shoes and place the item onto his feet. Marion advised that the defendant discarded the shoes that he was wearing when he entered the business. Marion followed the defendant at which time he observed him consume a package of sushi and a bag of Mounds candy which the defendant discarded the empty packaging within the business. Marion also observed the defendant conceal a sandwich into his waistband. Marion stated that he observed the defendant pass all points of sale, and inventory control device with the intent to deprive the merchant the full retail value of its merchandise. Marion advised at this time he identified himself, and attempted to detain the defendant until my arrival. This information was provided to Sergeant Koch and Officer Runge who located the subject walking south on US 19 at Grand Blvd. I was advised via radio that the defendant fled from Officer Runge when he attempted to stop the defendant. The defendant was later captured and detained behind the Famous Tate business located at 8010 Grand Blvd. Chief DeCanio responded to the scene with Marion who was able to positively identify the defendant as the subject he observed fleeing the business with the stolen merchandise, who resisted his attempts to recover Walmart’s property, and pushed him against his will.
