Basically what the authors talk about is the system that was set up in the twenty first century that relied on the three R’s to run itself. These three R’s are rehabilitation, restorative justice, and reentry programming. What the authors argue is that America created a system that was too cut and paste and focused on mass quantities of prisoners being integrated in and out of the system rather than looking at the quality of the system itself. The authors argue that at this time of progressive movements occurring it is quite possible to look at a better future for the American prison system that looks to improve the quality of life for prisoners and the system as a whole (Stohr, 258). Their main lessons that they suggest need to be learned in regards to the American prison system is that prisons should not harm inmates but should rather help them, prisons must be just and fair, prisons must be healthy, prisons must be held accountable, prisons need to be affordable and reserved for violent and repeat offenders, prisons must be developmental for staff, and that the humaneness found in prisons provides hope for a better future.…
With a total prison population of 2,217,000 people as of 2013, the United States continues to have the highest prison rate in the world (Institute for Criminal Policy Research). In light of these numbers, it is clear to many that the United States is in need of some kind of reform in the way it responds to crime and carries out justice, however, there is much disagreement on what aspects of our criminal policies need to be reformed and in what way. According to the Sentencing Project, which is a non-profit organization that promotes reduced reliance on incarceration and increased use of more effective alternatives to deal with crime, states that the United States correctional system of the past thirty years has been characterized by a population increasing the exponentially in response to changes in policy towards mandatory minimum and determinate sentencing (Sentencing). In other words, individuals convicted of a crime today are more likely to be sentenced to incarceration and spend longer terms in prison, than their counterparts in previous decades (Sentencing). Throughout the semester, we have repeatedly discussed statistics regarding current crime and incarceration rates. In comparison to previous rates, from earlier decades, it is clear that society’s viewpoint on crime has changed significantly. Beginning in the early 1970s, the United States initiated a more punitive criminal justice system (1). In The Punishment Imperative, authors Todd R. Clear and Natasha A. Frost created a concept for the reasoning behind this mass incarceration. Referred to as the “Punishment Imperative,” its basis for reasoning focused on the symbolic image that crime held in society; meaning, as crime rates grew, the societal fear for basic safety began to emerge.…
The research attempts to ascertain the impact that mandatory minimum sentencing guidelines have had on the criminal justice system as a whole in the United States. With its advent, mandatory minimum sentences have arguably had an economic impact on the justice system, particularly in corrections systems. Due to the fact that there are now more people being incarcerated for longer periods because of these sentencing guidelines, prisons are bearing an increasing cost for housing these inmates. Another factor that the research looks into is the inequities that are inherent when sentencing a non-violent offender with a sentence that is as stringent if not more so than those who have committed violent felonies. 2.2 million men, women, and youth are incarcerated in the United States right now (The Sentencing Project). The U.S. accounts for 5% of the world’s population, yet 22% of the world’s imprisoned population (Mass Incarceration). Mass incarceration has reached an increase of over 500% within the last 40 years (The Sentencing Project). Not only are more people being carelessly thrown into jails and prisons, but the number of people that are being released is less and not nearly equal to the number of inmates coming in because people are also being sentenced to longer terms. The $12.5 billion given to states with the 1994 Crime Bill “required inmates to serve at least 85 percent of their sentences” which is in part why sentences are longer served in the justice system (Brooke Eisen, Chettiar).…
The sole purpose of prison is to punish criminals for crimes they have committed, protect citizens from crime, and rehabilitate those individuals to be honest, law-abiding citizens once they are released back into the public. Wilbert Rideau, author of “Why Prisons Don’t Work”, was in the Louisiana State Penitentiary and has first-hand experience with how the prison system works. Prison is the punishment, but the punishments within the prison are inhumane and ineffective. High re-offense rates show that the public is not being protected from criminals; nor, are they rehabilitating those individuals to be productive citizens. Some would agree that providing severe sentencing options would deter some offenders from engaging in crime. However, research is limited in regard to the direct impact that three strikes laws have on deterring crime. Proponents of these laws have cited empirical evidence that claims prisoners do acquire about their strike status, thus indicating a deterrent effect, however, this claim remains questionable due to a lack of statistical support. An analysis conducted by the RAND Corporation during the late 90’s, assumed that three strikes would not have a deterrent effect on potential offenders, but would have an incapacitate effect by reducing the number of felonies committed by adults in California between 22 and 34 percent (Dickey & Hollenhorst, 1995). Many people think that incarceration is like a vacation at a country club until they see what really happens behind the bars. Offenders do not get the help that they need when they are in prison. The previously discussed ideologies had several problems with the effects that they caused. The current correctional practices have problems that have caused the desire for crime prevention to become prevalent. “Almost all offenders are eventually released, however, and the problem returns unless it has been effectively treated while the offender was in prison” (Allen 57). Prison reform is a significant issue for many Americans. The prison population is expanding at a phenomenal rate, often beyond the capacity of the existing system to accommodate the expanding ranks of the incarcerated. The focus for many is increasingly on rehabilitation as a means to reduce recidivism and consequently reduce the number of individuals who must be placed in prisons every year. In the early 1990s, the number of people jailed in the United States topped one million (Waldman, 2013). In the last 40 years, incarceration in the United States has reached epidemic proportions. We have the highest incarceration rate in the world; we hold 5% of the world’s population, but house 25% of the world’s prisoners (Kelly 2015). The use of incarceration has gradually become a more acceptable and more used form of punishment. As a result, our prison population is overflowing with offenders ranging from petty theft criminals to violent offenders. While there is wide consensus that tougher penalties are necessary and appropriate for those convicted of serious violent or sex offenses, many policymakers are questioning the need for long prison terms for people convicted of less serious crimes such as nonviolent drug offenses. Some of these provisions were reversed during the fiscal crisis earlier this decade, resulting in severe prison overcrowding. States are also presented with a growing number of elderly and chronically ill prisoners whose ongoing care requires significant resources. To address these issues, officials have added or modified the laws and policies that determine the amount of time people spend in prison. In the early 1990’s, negative perceptions of the prison system brought about the “Nothing Works” doctrine, which argued that rehabilitation programs are a waste of the public’s time and money when concerning criminal behavior. Therefore, the Nothing-Works doctrine was the beginning, and brought about the truth-in-sentencing laws that were enacted to reduce the possibility of early release from prison. The primary goal of the truth-in-sentencing laws was focused on retribution and was implemented to provide tougher punishment with the hopes of reducing crime rates (Foster, 2006).
