The only time I can think this may apply is for positions such as pilots, police officer, or any other position that requires heavy physical activity. I question that thinking at times, though. To say that someone cannot do a job because they are over 40, 50, 60 etc. is another form of discrimination. When the court system gets involved, it can turn into an ugly situation for the company and those involved. Large office supply retailer, Staples knows this firsthand. Let us get into some specifics.

I would be willing to wager that almost every major corporation that has been in business for 25 or more years, has been through some sort of lawsuit. Bobby Dean Nickel, 64 was hired by Corporate Express in August of 2002 to be their facilities manager. Six years later, Corporate
