Section 28LB, an injury include damage of bodily function, psychiatric or psychological damages. Section 28LNA,regarding to certificate of assessment, a medical center authorized by the goverment have the faculty to diagnose the degree of damage of an individual. Section 135A (19), serious injury is an event that disrupts the normal life of the worker. Therefore an employee is in a serious condition after experienced: damage of bodily function, behavioural disorders and serious changes of physical characteristics that affect a worker to live a normal life.

    Espinoza stated that on the claimant’s LDW 11-25-2015, she was told by Supervisor Navarrete that he had information from the claimant showing that he had a pre-existing industrial back injury.
