In summary, on 08/04/17 at 2234 hours, Ofc. Coleman #214 and I assisted Tactical Officers (T/O) Robinson #390 and E. Perez #397 in regards to DUI investigation located at 1400 S 58th Avenue.

Upon arrival, I spoke with T/O E. Perez #397, who related he observed a vehicle parked in yellow with person in the driver seat sleeping. T/O E. Perez #397 further related he woke up the driver, who was now identified as (Diego Hernandez, Juan Jose DOB 04/22/94). Juan had signs of impairment (glassy bloodshot eyes and a strong odor of an alcoholic beverage emanating from his breath/person).

Horizontal Gaze Nystagmus (HGN) test - Juan related he does not have any problems with his eyes. I observed him to have equal pupil size and tracking in each eye, so I continued with the HGN test. I gave the instruction to Juan and he stated that he understood them. Juan moved his head during the test. I gave the instruction two (2) more times, until he was able to follow the instructions. Juan had a lack of smooth pursuit in both eyes. Juan had distinct and sustained Nystagmus in both eyes at maximum deviation. Juan also had onset of nystagmas prior to 45 degrees. Juan showed six (6) clues during the test.

Walk and Turn - Juan was unable to maintain his balance and did not maintain the heel to toe position throughout the instructions part of the test. Juan missed heel to toe on all his steps on the first and second set of steps (more than a 1/2 inch), by crossing his feet on each step. Juan also made an improper turn after the first set. Juan took the incorrect number of steps on the first set (12 steps) and the second set (10 steps). Juan stumbled on his last step on the second set almost hitting a fence.
