Rape Shield Laws have attracted a lot of argument and opinions on the ethical wellbeing of the laws. There are several ethical concerns that are connected with the law that include the right of the jury to nullify a rape case. The other ethical concern is the way they are preventing a man accused of rape of mounting a defense. Additionally, there is still the issue of the use of the law has been used inappropriately in the juries (Swiss, 2013). The exertion of the law has led to the conviction of people who have nothing to do with the rape or rather are not guilty. It is unethical to rule out the evidence that can be given by the sexual history of a victim. There has been much misuse of the rape shield laws across the legal system.
