The Electronic Communications Privacy Act of 1986 (ECPA) prohibits the unlawful and intentional interception of any wire, oral, or electronic communication (18 USC 2510 et seq.,18 USC 2701 et seq.). Title II of ECPA, the Stored Communications Act (SCA), also prohibits access to such information while in electronic storage (Bruce, 2013). There are three broad statutory exceptions that might prove useful to employers. The provider exception, the business-use exception, and the prior-consent exception. (Bruce, 2013). Work related, can be broadly reviewed as using your work station, therefore the company owns all rights. Another work around for the employer is having it written in the terms of employment. One could argue that access of the clock, not being paid, the employee could argue that the company has no right. Another problem would illegal background checks, most state make the employer get permission to conduct a background check on the employee prior. The work around would be by including it as part of the terms of employment. Personal Records, Employees generally have a right to privacy in their personnel records, except in a few specific circumstances (All Business, 2016).
