For the foregoing reasons, and since a genuine issue of material fact does not exist, the Defendant is entitled to judgement as a matter of law. Both Plaintiff and Defendant agree on the facts surround the events of the night of July 2, 2016. Consequently, the Plaintiff has no grounds to continue his suit against the Defendant. The Defendant respectfully requests that this Court grant the Defendant’s motion for summary judgement.
