On 9/6/17 I met Mr. Reid at the office of Dr. Rampersaud. I have printed and provided Mr. Reid the information on how and where to get medications filled along with a form for him to fill out for reimbursement of prior out of pocket expenses. I also provided Dr. Rampersaud with a letter with requirements and instructions on filling medications. I met Mr. and Mrs. Reid at the appointment with Dr. Rampersaud. The wait was very long so we have a long opportunity to go over the prescription medication coverage and how to get reimbursed for the prior medication expenses. I provided them with the information provided by the adjuster. I also provided Dr. Rampersaud a copy so the medications are processed through the pharmacy company. Dr. Rampersaud will do another injection on 9/11/17. While he is under sedation he will check the battery pack. There were no changes to the medications. Mr. Reid continues to report his legs giving out and having severe spasm to the back and legs at night. I was going to ask about that if I had a chance. He says his wife has to physically move him when that occurs. Mr. Reid was told that the narcotics cannot be prescribed for 90 days. They faxed the Elavil, Motrin, and Ultram and will mail the Morphine prescription. Because it says that it can be 10 days before the medication arrives at him he was given paper orders for 10 days worth of medication. I have advised both the doctor office and Mr. Reid that there is a contact number for any questions. I stressed that they have to use this if they

There was no indication of symptoms or physical findings that would support the medical necessity of the service at the level billed, in accordance with Medicare Guidelines. For the procedure code 20553 to be considered medically necessary and reasonable, an appropriate payable diagnosis needs to be billed as outlined in the Local Coverage Determination (LCD) (L30155).…

In this case, the Appellant’s Representative/daughter SS submitted an exhibit which included various monthly recurring household expenses. (Exhibit C-1) The ALJ reviewed these expenses to determine if the expenses were causing financial duress for the CS. The regulations however state that the opportunity to increase the CSMNA was not to “guarantee the amenities of any current lifestyle” but rather to prevent the impoverishment of a Community Spouse. The ALJ looked at the Appellant’s verified expenses: water bill of $60.25, electric bill of $287.56, home owner’s insurance of $62.00 (stipulated by the parties; previously verified by the Department), phone bill of $231.94, real estate taxes of $124.33, gas bill of $141.29 The CS total shelter expenses were $907.37.…
